IMPORTANT: Please read this End User License Agreement ("Agreement") carefully before installing or using Brutal Copy 2 ("Software"). By installing, copying, or otherwise using the Software, you ("User", "you") agree to be bound by the terms of this Agreement. If you do not agree, do not install or use the Software.

This Agreement is a legal contract between you and Limintel PTY LTD, an Australian proprietary limited company ("Limintel", "we", "us", "our").

1. Definitions

"Software" means the Brutal Copy 2 application, including all executable files, libraries, shell extensions, documentation, updates, and associated materials.
"License Key" means the digital key or credential provided to you upon purchase that activates a specific license type.
"Machine Identifier" means a unique identifier derived from your computer's hardware characteristics, used solely for license validation purposes.

2. Grant of License

Subject to your compliance with this Agreement, Limintel grants you a limited, non-exclusive, non-transferable, revocable license to install and use the Software in accordance with the terms of your specific license type:

Trial License

Permits evaluation of the full Software for thirty (30) days from the date of first activation on your machine.
Trial periods are enforced per-machine and cannot be reset by reinstallation, registry modification, or any other means.
A one-time extension of thirty (30) days may be granted at Limintel's sole discretion upon submission of product feedback.
After the trial period expires, you must purchase a license to continue using the Software or uninstall it.

Perpetual License (Machine Key)

Permits installation and use of the Software on a single computer indefinitely.
The license is bound to the specific machine on which it is activated via the Machine Identifier and is non-transferable between machines unless Limintel provides a license reset at its discretion.
Includes one (1) year of free updates from the date of purchase. After the update period expires, the Software continues to function but will not receive further updates without renewal or a new purchase.
A perpetual license is valid only for the specific Limintel product for which it was purchased.

Subscription License

Permits installation and use of the Software and all Limintel products for the duration of the active subscription period.
Requires periodic internet connectivity for license validation. An offline grace period of seven (7) days is provided.
Access to the Software ceases when the subscription expires or is cancelled, and you must uninstall the Software.

Enterprise License

Governed by a separate enterprise agreement between your organisation and Limintel. Contact info@limintel.com for details.
Enterprise licenses permit installation on the number of machines specified in the enterprise agreement.

3. Restrictions

You may NOT:

Reverse engineer, decompile, disassemble, or otherwise attempt to derive the source code of the Software, except to the extent expressly permitted by applicable law;
Modify, adapt, translate, or create derivative works based on the Software;
Copy the Software except for a single backup copy for archival purposes;
Distribute, sublicense, lease, rent, lend, sell, or otherwise transfer the Software or your license to any third party;
Remove, alter, obscure, or tamper with any proprietary notices, labels, watermarks, or branding on or in the Software;
Circumvent, disable, or interfere with any license validation, trial enforcement, activation mechanism, or copy protection feature of the Software;
Use the Software for any purpose that violates applicable local, state, national, or international law or regulation;
Use the Software to infringe upon the intellectual property rights, privacy, or other rights of any third party;
Share, publish, or disclose your License Key to any third party;
Use the Software in a service bureau, hosting, or time-sharing arrangement for the benefit of third parties without a separate commercial agreement with Limintel.

4. Intellectual Property

The Software, including all code, designs, user interfaces, graphics, documentation, and associated materials, is the exclusive property of Limintel PTY LTD and is protected by Australian and international copyright, trademark, trade secret, and other intellectual property laws.

This Agreement does not grant you any ownership interest in the Software. All rights not expressly granted herein are reserved by Limintel.

The name "Brutal Copy", the Limintel name, and associated logos and marks are trademarks of Limintel PTY LTD. You may not use these marks without prior written consent.

5. Data Collection and Privacy

License Data: The Software collects and transmits a Machine Identifier (derived from hardware characteristics) and, for subscription licenses, your email address, solely for the purpose of license validation. Trial records include the machine identifier and trial start/end dates.
No File Data: The Software does NOT collect, transmit, or access the contents of your files. All file copy, move, delete, sync, hash, rename, and other file operations occur entirely on your local machine.
Update Checks: The Software may periodically contact Limintel servers to check for updates. These requests include only the current Software version number.
AI Features: If you use the optional AI-powered features, data you submit (such as file names or natural language prompts) may be transmitted to third-party AI service providers (such as OpenAI or Anthropic) for processing. File contents are never sent unless you explicitly include them in a prompt. You may use your own API key ("Bring Your Own Key") or the provider-funded option, which is rate-limited.
Local Storage: License and configuration data stored on your machine is protected using Windows Data Protection API (DPAPI) encryption.

6. Third-Party Components

The Software includes third-party open-source and commercial components. These components are subject to their own license terms. Key third-party components include but are not limited to:

BLAKE3 hash algorithm implementation
LZ4 / K4os.Compression (data compression)
AlphaVSS (Volume Shadow Copy access)
GroBuf (binary serialization)
System.IdentityModel.Tokens.Jwt (license validation)

Limintel's use of these components does not grant you any additional rights beyond those specified in their respective licenses.

7. Updates and Modifications

Limintel may release updates, patches, or new versions of the Software from time to time. Updates may be installed automatically or require manual action, depending on your settings.

Limintel reserves the right to modify, discontinue, or retire the Software or any feature thereof at any time, with or without notice. Perpetual licenses will continue to function for the version installed at the time of retirement.

Updated versions of the Software may be subject to additional or modified terms. Your continued use of an updated version constitutes acceptance of any revised terms.

8. Disclaimer of Warranties

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW:

THE SOFTWARE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTY OF ANY KIND, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE. LIMINTEL SPECIFICALLY DISCLAIMS ALL IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

LIMINTEL DOES NOT WARRANT THAT: (a) the Software will meet your requirements or expectations; (b) the Software will be uninterrupted, timely, secure, or error-free; (c) the results obtained from use of the Software will be accurate or reliable; (d) any errors in the Software will be corrected; or (e) the Software will be compatible with third-party software or hardware.

You acknowledge that the Software performs file operations including copying, moving, deleting, and overwriting files. You are solely responsible for maintaining adequate backups of your data. Limintel is not responsible for any data loss resulting from use of the Software.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW:

In no event shall Limintel, its directors, officers, employees, agents, or affiliates be liable for any indirect, incidental, special, exemplary, consequential, or punitive damages, including but not limited to loss of data or data corruption, loss of profits or revenue, loss of business or business interruption, loss of goodwill or reputation, or cost of procurement of substitute goods or services.
Limintel's total aggregate liability arising out of or related to this Agreement shall not exceed the amount you actually paid for the Software license in the twelve (12) months preceding the claim.
These limitations apply regardless of the legal theory on which the claim is based, including contract, tort (including negligence), strict liability, or any other theory.
Some jurisdictions do not allow the exclusion or limitation of certain damages. In such jurisdictions, Limintel's liability shall be limited to the maximum extent permitted by law.

10. Indemnification

You agree to indemnify, defend, and hold harmless Limintel and its directors, officers, employees, and agents from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising out of or related to:

Your use or misuse of the Software;
Your violation of this Agreement;
Your violation of any applicable law or regulation;
Your infringement of any third-party rights.

11. Refund Policy

Perpetual License: Limintel offers a thirty (30) day money-back guarantee on perpetual licenses. If you are not satisfied, contact info@limintel.com within thirty (30) days of purchase for a full refund. Upon refund, your license will be deactivated and you must uninstall the Software.
Subscription License: Subscription refunds are prorated for unused full months remaining in the current billing period.
Trial License: Trial licenses are provided free of charge and are not subject to refund.

12. Export Compliance

The Software may contain cryptographic components and may be subject to export control laws and regulations. You agree to comply with all applicable export and import laws and regulations, including without limitation the Australian Defence Trade Controls Act and any applicable laws of the country in which you use the Software.

13. Termination

This Agreement is effective until terminated.
Automatic Termination: This Agreement and your license terminate automatically and immediately if you fail to comply with any term or condition of this Agreement.
Subscription Termination: Subscription licenses terminate upon expiry or cancellation of the subscription, or upon non-payment.
Termination by Limintel: Limintel may terminate this Agreement at any time if you breach its terms, with or without notice.
Effect of Termination: Upon termination, you must immediately cease all use of the Software and destroy all copies of the Software in your possession or control, including backup copies. Sections 4, 5, 8, 9, 10, 12, and 15 survive termination.

14. Governing Law and Dispute Resolution

This Agreement shall be governed by and construed in accordance with the laws of the Commonwealth of Australia, without regard to its conflict of law provisions.
Any dispute arising out of or relating to this Agreement shall be subject to the exclusive jurisdiction of the courts of Australia.
Before initiating any legal proceedings, you agree to first attempt to resolve any dispute informally by contacting Limintel at info@limintel.com.

15. General Provisions

Entire Agreement: This Agreement, together with any applicable enterprise agreement, constitutes the entire agreement between you and Limintel regarding the Software and supersedes all prior agreements, understandings, and communications, whether written or oral.
Severability: If any provision of this Agreement is held to be unenforceable or invalid, that provision shall be modified to the minimum extent necessary to make it enforceable, and the remaining provisions shall continue in full force and effect.
Waiver: The failure of Limintel to enforce any right or provision of this Agreement shall not constitute a waiver of such right or provision.
Assignment: You may not assign or transfer this Agreement or your license without Limintel's prior written consent. Limintel may assign this Agreement without restriction.
Notices: Limintel may provide notices to you via email (if provided during registration), in-product notifications, or by posting on the Limintel website.
Force Majeure: Limintel shall not be liable for any delay or failure to perform resulting from causes beyond its reasonable control, including but not limited to acts of God, natural disasters, pandemics, war, terrorism, government actions, or failures of third-party services.
Amendments: Limintel reserves the right to modify this Agreement at any time. Material changes will be communicated via the Limintel website or in-product notification. Your continued use of the Software after such changes constitutes acceptance.
Australian Consumer Law: Nothing in this Agreement is intended to exclude, restrict, or modify any consumer rights under the Australian Consumer Law (Schedule 2 of the Competition and Consumer Act 2010) or any similar legislation that cannot be excluded by agreement. If the Australian Consumer Law applies to you, our liability for goods or services not of acceptable quality is limited, at our option, to resupply of the services or payment of the cost of resupply.
